Driving after having either consumed or incorporated into the organism toxic drugs or narcotics is harshly punished in Spain. It is also forbidden driving after having consumed medicaments or other substances which alter either the appropriate physical or mental state to drive safely. Being under an obligation to be put to tests is similar to the case mentioned above, related to the blood level of alcohol. Tests shall consist of a medical examination of the obliged person and, also of clinical analysis which are considered appropriate either by the forensic surgeon or by the medical staff of the Health Centre, where the person was brought. Tests must be done again at the request of the interested party, and they might consist of blood or urine analysis. Administrative sanctions are similar to those mentioned in the section related to the blood level of alcohol. Likewise, driving under the influence of either toxic drugs or narcotics may be an act constituting a crime, in the same way than driving under the influence of alcoholic drinks. |
