The protection of consumers in Greece is described in the Law 2251/94. The law says:
“The State shall protect the interest of the consumer. Specifically, the State shall safeguard the health and safety of consumers, consumers’ economic interests, the right to adhere to consumer associations, the right of consumers to make their views known with regard to issues which affect them and the right to information and education in relation to consumer affairs. Provisions to protect consumers shall apply both to private firms and to all kinds of public sector firms and firms belonging to local government organizations”.
The above mentioned law was completed by the law 3587/07, which specifies the issues about consumers’ organizations and embodies the directive 2005/29of EU. This directive concerns unfair business – to – consumer commercial practices in the internal market of EU.
The Law 3043/02 refers to the responsibility which has a provider or seller to the consumers.
Since the safety of the consumers is a very significant point of the legislation the Ministerial Decisions Φ1-503/1996 and Z3/2810/2004 describe what is a safe and/or a dangerous product.
The consumers rights (e.g. protection of the health and safety, protection of the economical interests of the consumers, appeal to the justice, education of the consumers, information of the consumers, representation of the consumers and sustainable consumption), as well as the legislation, judicial decisions and advices for the consumers can be found in the Websites of EKPIZO (http://www.ekpizo.gr) and of the Ministry of Development, General Secretariat for the Consumer’s Protection (http://www.efpolis.gr ).
Ο κύριος νόμος για την προστασία των καταναλωτών είναι ο Ν. 2251/94. Αυτός ορίζει ότι:
“Το κράτος πρέπει να μεριμνά για την προστασία των καταναλωτών. Ειδικότερα, πρέπει να διασφαλίζει την υγεία και την ασφάλειά τους, τα οικονομικά τους συμφέροντα, το δικαίωμά τους για την δημιουργία ενώσεων καταναλωτών, το δικαίωμα ακρόασής τους για θέματα που τους αφορούν, καθώς και για την πληροφόρηση και εκπαίδευσή τους, ιδιαίτερα των ευπρόσβλητων ομάδων σε θέματα που αφορούν στην αγορά, τον ανταγωνισμό, τον καταναλωτή, την προστασία του φυσικού περιβάλλοντος και την προαγωγή της βιώσιμης κατανάλωσης. Οι διατάξεις του νόμου εφαρμόζονται σε κάθε προμηθευτή, φυσικό ή νομικό πρόσωπο, οποιασδήποτε μορφής του δημόσιου και ιδιωτικού τομέα”.
Ο παραπάνω νόμος τροποποιήθηκε και συμπληρώθηκε από τον Ν. 3587/07, ο οποίος ρυθμίζει κυρίως θέματα των ενώσεων καταναλωτών και έχει ενσωματώσει την Ευρωπαϊκή Οδηγία 2005/29. Η Οδηγία αυτή αφορά στις αθέμιτες πρακτικές προς τους καταναλωτές στην εσωτερική ευρωπαϊκή αγορά.
Ο Ν. 3043/02 αναφέρεται στην ευθύνη του πωλητή έναντι του καταναλωτή.
Καθώς η ασφάλεια των καταναλωτών είναι κεφαλαιώδους σημασίας, οι Υπουργικές Αποφάσεις Φ1-503/1996 and Z3/2810/2004 περιγράφουν τι σημαίνει ασφαλές και τι επικίνδυνο προϊόν.
Τα δικαιώματα των καταναλωτών (δηλ. η προστασία της υγείας και ασφάλειας, η προστασία των οικονομικών συμφερόντων, η προσφυγή στη δικαιοσύνη, η πληροφόρηση και η εκπαίδευση των καταναλωτών, η εκπροσώπηση και η βιώσιμη κατανάλωση), καθώς επίσης, η σχετική νομοθεσία, δικαστικές αποφάσεις και συμβουλές μπορούν υπάρχουν αναρτημένες στις ιστοσελίδες της ΕΚΠΟΙΖΩ (http://www.ekpizo.gr) και της Γενικής Γραμματείας Καταναλωτή (http://www.efpolis.gr ). |
